Ordinance No. 148 An ordinance
calling an election to secure the consent of a majority of the electors of the
city of Blair, Washington County, state of Nebraska, to the construction and
operation of a street railway in and upon the streets of said city by the Blair
Street Railway Company.
Be it ordained by the mayor and council of the city of Blair.
Section 1.
That under the provisions of an act entitled "an act to provide for the
incorporation of street railroad companies, within cities of the state" approved
February 15, 1877, a special election is hereby called and ordered to be held in
the city of Blair, on the 11th day of November, 1889, and the mayor of said city
is hereby requested to properly call and give notice of such election for the
purpose of giving the qualified voters of said city an opportunity to grant or
refuse their consent to the Blair Street Railway Company to construct and
operate a street railway with cars propelled, either by horses, cable,
electricity, compressed air or such other motor, except steam locomotive, as may
be practicable for the operation of street railways, with suitable turnouts,
constructions and turntables over and across, in and along the following streets
in said city to wit: commencing at Front and 7th Street near the Blair passenger
depot, thence south on 7th Street to Washington Street, thence west on
Washington Street to West Street: from Prospect Street, north along Walker
Avenue to Nebraska Street and along Nebraska Street east to 11th Street, north
on 11 to Jackson Street, thence east on Jackson Street when extended to Blair
cemetery; from 10th Street on Grant Street west to Center Street thence north on
Center Street to Jackson Street; from Walker Avenue west on Nebraska Street to
French Street.
Section 2.
The places of voting shall be the usual voting places in said city and shall be
in the notice calling such election. The returns thereof shall be made to the
council and canvassed by said city council. The judges and clerks of election
shall be appointed in the same manner as per other city elections.
Section 3.
The form in which said question shall be taken shall be as follows: "shall
consent of right of way and authority be given, the Blair Street Railway
Company" to construct and operate a street railway with cars propelled either by
horse, cable, electricity, compressed air, or such other motor, except steam
locomotive, as may be practicable for the operation of street railways, with
suitable turnouts, constructions and turntables in the city of Blair, on and
through the following streets in said city, viz, commencing at Front and 7th
Street near the Blair passenger depot thence south on 7th Street to Washington
Street, thence west on Washington Street to West Street; from Prospect Street
north along Walker Avenue to Nebraska Street and along Nebraska Street east to
11th Street, north on 11th to Jackson Street, thence east on Jackson Street when
extended to Blair cemetery; from 10th Street; west on Colfax Street to second
street; from 10 street on Grant Street west to Center Street thence north on
Center Street to Jackson Street.
All votes in favor of said proposition shall have attached to
said form of proposition the word "yes" and all votes cast against said
proposition shall have attached to said form of proposition the word "no."
Section 4.
If a majority of the electors of the city of Blair vote in favor of giving such
consent right of way and authority it shall vest such consent right of way and
authority in the Blair Street Railway Company to construct, maintain and operate
such street railway over and across in and along said streets. Provided that the
franchise hereby granted shall not be deemed to be exclusive and provided that
said company shall commence the actual construction of said street railway on or
before the first day of June, 1890, and shall fully construct and equip at least
one and one-half miles of said railway track, on or before the first day of
January, 1891. Provided further that said railway track shall be so constructed
and maintained as to present the least possible obstruction to the ordinary and
public use of such streets, and that it shall when required conform to the
established grade as run or hereafter to be established when such streets are
brought to grade. And further said railway company shall be subject to all
reasonable regulations in the construction and use of said railway, which may be
imposed by ordinance.
Section 5. That the center of track of said railway shall be
the center of streets over which said railway shall be constructed, except where
turnouts are constructed.
Section 6.
That whenever any of said streets shall be paved by said City, where said Blair
street railway company shall have any part or portion of its track, then said
Blair street railway company shall pave so much of said track as shall be
between the rails of its said track and one foot on the outside of the rails of
its said track.
Section 7.
This ordinance shall be in force from and after its passage, approval and
publication according to law.
